Terms of Service

By installing, accessing, or using the Dream Afar Chrome extension ("Extension", "Service", or "Dream Afar"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Extension.

These Terms constitute a legally binding agreement between you and Dream Afar ("we", "us", or "our") regarding your use of the Extension.

Dream Afar is a Chrome browser extension that transforms your new tab into a productivity hub with beautiful wallpapers and useful widgets. The Extension allows you to:

• Display curated wallpapers from various collections (Unsplash, Google Earth View, Google Arts & Culture)
• Upload and use custom wallpapers stored locally on your device
• Access productivity widgets (time, weather, todos, notes, shortcuts, focus timer, etc.)
• Customize your new tab experience with configurable layouts and settings
• Use site blocking features during focus sessions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to:

• Download, install, and use the Extension on devices you own or control
• Access and use the Extension's features for personal or internal business purposes

This license does not grant you any rights to:

• Modify, adapt, translate, or create derivative works of the Extension
• Reverse engineer, decompile, disassemble, or attempt to discover the source code
• Rent, lease, sell, assign, sublicense, or otherwise transfer rights to the Extension
• Remove, alter, or obscure any proprietary notices on the Extension
• Use the Extension for commercial redistribution or to build a competitive product

You retain all rights to any content you create, upload, or store using the Extension ("User Content"), including but not limited to:

• Custom uploaded wallpapers
• Todo lists and notes
• Shortcuts and bookmarks
• Widget configurations and settings

You represent and warrant that:

• You own or have the necessary rights to all User Content you upload or create
• Your User Content does not violate any third-party rights (copyright, trademark, privacy, etc.)
• Your User Content complies with these Terms and applicable laws

Dream Afar is intended for users who are at least 13 years old. If you are under 18 years old (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use the Extension.

If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information.

You agree not to use Dream Afar to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload or distribute content that is illegal, harmful, threatening, abusive, or offensive
• Upload content containing viruses, malware, or other harmful code
• Attempt to circumvent security measures or access restrictions
• Reverse engineer, decompile, or disassemble the Extension
• Use automated systems to access the Extension in ways that exceed reasonable human usage
• Interfere with or disrupt the Extension, servers, or networks
• Impersonate any person or entity
• Collect or harvest information about other users

The Extension and its original content, features, design, and functionality are owned by Dream Afar and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Dream Afar" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Dream Afar. You may not use such marks without our prior written permission.

Third-party trademarks, service marks, and logos used in the Extension (such as Unsplash, Google) are the property of their respective owners.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information.

By using Dream Afar, you acknowledge that you have read and understand our Privacy Policy, and you consent to the data practices described therein.

Dream Afar is distributed through the Chrome Web Store and is subject to Google's policies:

• Your use of Chrome extensions is governed by Google's Terms of Service
• If you enable Chrome Sync, your settings may be synced according to Chrome Sync privacy practices

• We do not warrant that the Extension will be uninterrupted, secure, or error-free
• We do not warrant the accuracy, completeness, or reliability of wallpapers, weather data, or other third-party content
• We are not responsible for the availability or functionality of third-party services (Unsplash, weather APIs, etc.)
• We do not guarantee that the Extension will meet your specific requirements
• You use the Extension at your own risk

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAM AFAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Extension
• Any conduct or content of third parties using the Extension
• Unauthorized access to or alteration of your transmissions or data
• Third-party content (wallpapers, weather data) or service interruptions
• Any bugs, viruses, or harmful components transmitted through the Extension

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (WHICH, FOR FREE USERS, IS ZERO).

You agree to indemnify, defend, and hold harmless Dream Afar and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the Extension
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Your use of third-party content or services through the Extension

We reserve the right to modify, suspend, or discontinue the Extension (or any part thereof) at any time, with or without notice, for any reason including but not limited to:

• Maintenance and technical improvements
• Changes to third-party service availability
• Legal or regulatory requirements
• Business decisions

We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Extension.

We may update these Terms from time to time at our discretion. We will notify you of material changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date at the top of this page
• Providing notice within the Extension (for significant changes)

Your continued use of the Extension after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Extension.

You are advised to review these Terms periodically for any changes.

We may terminate or suspend your access to the Extension immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your use of the Extension at any time by uninstalling it from your browser.

Upon termination, your right to use the Extension will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Extension shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

You may seek injunctive relief in court for matters relating to intellectual property infringement or violation of these Terms.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dream Afar regarding the Extension and supersede all prior agreements, understandings, and communications, whether written or oral.
